Submitted to Socialism collateral appeal of Gerardo Hernández

Today was filed June 14 in Miami Federal Court of Appeal collateral (also known as habeas corpus beyond) on behalf of the Hero of the Republic of Cuba Gerardo Hernandez. This is the last legal recourse for him within the United States.
Gerardo Hernandez was arrested in September 1998 and sentenced in December 2001 to two life sentences plus 15 years.
They did pay of the Government was discovered in 2006, five years after the trial ended.
also include violations by the government through manipulation of evidence, forgery, and in many cases their concealment to obstruct justice.
technical aspects in the performance of the defense will also be analyzed.
Regardless of the final results can be achieved within the legal order, this process will allow us to demonstrate more strength in the legal order the innocence of our colleague, once again explain the procedural violations, the Government's prevarication over the entire the process and how its realization in Miami was a denial of justice.
The collateral appeal is just the name of Gerardo, because his case was closed to the Supreme Court denied review on June 14, 2009 and therefore it is only this extraordinary procedure. His four colleagues still have other opportunities and resources that will be used by defense lawyers.
keep fighting because they do justice to them all. We will continue demanding the release of Gerardo, Ramón, Antonio, Fernando and René.
Each day spent in prison is an affront to justice. Gerard himself has said. Justice will only come when rendered by a jury of millions. It takes many actions to overcome the silence, the American people know the truth and demand their government to release unconditionally and Five immediately.
It's time to multiply the complaint and solidarity. Demonstrate to Washington that we Yes we can. For honest people that this is not an empty slogan but a demand that will follow you forever.

On Wednesday May 5, 2010, authorities Media Institute of Higher Education of the Federal District (AIMS-DF) and representatives of the Union of the Workers Union IEMS-DF (SUTIEMS), established an agreement in which Clause Three established the obligation for the Institute, reinstate workers Solórzano and Daniel Jesus Barrera Ivy Capdeville and make payment of wages that rightfully belongs to them, from May 16 this year, after withdrawal of the lawsuits launched against the AIMS- DF for his unfair dismissal.

that Convention the AIMS-DF agreed to perform the necessary administrative procedures for workers above to return to work within the Institute on such terms and conditions are agreed with the union, however, that agreement has not been met in full.

So far, the authorities of the AIMS-DF only have complied with the reinstatement of Jesus Barrera Solórzano. The reinstatement of Daniel Capdeville Ivy has not been done. Both workers had a place of Teacher-Tutor-Investigator (DTI) before fired without justification, the former administrative functions at the Headquarters of the Institute and the second at the high school academic functions "Francisco J. Mugica (Tlalpan 1).

Jesus Barrera

Solórzano was reinstated to his post of DTI in the Directorate of Information and Support, but the schedule is assigned a gross violator of Section 20 of the Collective Bargaining Agreement (CCT) in force in establishing the length of working hours.

According to Managing Director of AIMS-DF, Mr. Aldo Segura Pavón, hours of work to be covered Jesus Barrera Solórzano is from 9:00 to 15:00 and from 17:00 to 19:00 pm, Monday through Friday. However, this schedule is not referred to in Clause 20 of the CST. In

Clause 20 of the current CST identifies four types of schedules depending on the personal work that exists in the AIMS-DF:

1) For the school system administrative workers the morning shift schedule is from 7:30 to 14: 30 hours, Monday through Friday, while for the afternoon shift is from 13:00 to 20:00.

2) For System Administrative Workers Semi-schooled in the morning shift schedule is from 7:30 to 14:30 hours, Tuesday through Saturday, while for the afternoon shift is from 13:00 to 20:00.

3) For the Central Area Administrative Workers schedule is from 9:00 to 16:00 pm, Monday to Friday, while for the afternoon shift is from 13:00 to 20:00.

4) For the school system Academic Workers morning shift hours are 8:00 to 16:00 hours, Monday through Friday, while for the afternoon shift is from 12:00 to 20 : 00 hours.

hours assigned by the Managing Director of AIMS-DF Barrera Jesus Solorzano not covered by any of these options and, therefore, is thereby violating Clause 20 of the CST, although in that time it is serving the eight-hour workday as it marks the Section 61 of the Federal Labor Law (LFT) because if that was it, all administrative employees would be breaking the eight-hour workday, because according to clause 20 of the CST, his daily work is only seven hours, which is not true of academic workers.

addition, having a place of DTI, Jesus Barrera Solórzano it should be regarded as an academic worker, regardless of the administrative functions performed in the Directorate of Information and Technical Support and, therefore, should be one of the schedules to Clause 20 of the CST for academic workers, or possibly, if you want to consider as an administrative employee of the Central Area, for the administrative functions of the DTI has its place, then it should comply with the time scheduled for such personnel, based on Clause 20 of the CST.

not forget that the current CST Clause 16 states that "Individual employment contracts are established with core staff of the Institute shall comply with this Agreement and their formats will be agreed bilaterally." In that sense, Jesus Barrera Contract signed Solórzano and regulates the working relationship established with him can not be above the CST. Otherwise, it would also violate Section 16 of the CST, addition of Clause 20 thereof.

therefore SUTIEMS members demand full compliance with the agreement signed with the AIMS-DF and CST respect to existing or else we will have to deploy soon to strike at the Institute for violations of CST have authorities committed IEMS-DF.

worth remembering that the agreements concluded by the representatives and the authorities SUTIEMS IEMS-DF, before the Local Board of Conciliation and Arbitration of the Federal District, has the status of res judicata, as if it were an enforceable award , so that compliance is mandatory for both parties.

FOR THE IMPLEMENTATION OF THE AGREEMENT BETWEEN ESTABLISHED AND AIMS-DF SUTIEMS

REINSTATEMENT NOW

RESPECT TO THE TERMS OF CCT

Sincerely

By education and decent work!

"CONSENSUS BUILDING CITIZEN"

peoples, communities organizations and individuals present at the Public Forum Oaxaca "Citizens Consensus Building", which met on June 4 this year on the esplanade of the former Convent of Santo Domingo in Oaxaca, in order to discuss ideas and ways to initiate an alternation political and democratic transition in Oaxaca, to move from an authoritarian regime to a democratic state, which requires the organized participation of civil society and social movements.

This Forum, organized by networks and social fronts that mark this ruling, we recognize that the current system of government in Oaxaca, has been characterized by authoritarianism and taxation and the fact that the established institutions are totally collapsed and this has brought suspicion and discredit citizens, in which the fundamental demands of the population remain unresolved.

Furthermore, this deterioration in living conditions, has plunged the population in poverty, marginalization and inequality. Yet we recover from the wounds and consequences we left the repression of 2006, when we suffer imprisonment, harassment, disappearance and murder of men and women whose only crime has been unsatisfied and organized view of the serious rights violations elementary, as well as those oriented to create conditions of life more democratic, fair and decent.

Within the unfulfilled aspirations of the people, besides solving the basic needs are: respect for human rights, a law enforcement clear and expeditious, non-violence against women, respect for indigenous peoples' rights: land, territory and natural resources, and the exercise of democracy and autonomy, through citizen participation and strengthening of community structures, among others.

While recognizing that fundamental changes are needed, but not exhausted with electoral political participation, we are taking a step, assuming as part of a long-term process that reaffirms also the civil and political rights and progress toward a fundamental transformation. For this, the citizens' political participation is now a fundamental tool in the fight for democracy, peace and justice in Oaxaca.

Among the challenges and tasks before us, we agree:

strengthen the similarities and common visions, to achieve unity of action against the agreed change strategies, which, without blurring each of the identities - come together to confront the resistance of change of current and generates power a social force able to promote them.
Recognizing the diversity of existing strategies for achieving this new society and government in Oaxaca, without going into discrediting that undermine and inhibit, greater participation of the population and another is sought harmony and complementarity between all parties for the common good. It is therefore of fundamental importance to establish priorities based on the democratic yearnings and aspirations of Oaxaca.
Reaching agreements in a different context from the perspective of intercultural dialogue and consensus. Intercultural dialogue will trace the views and tendencies homogeneous, based on the diversity of logics and views on common phenomena.
promote consensus building and a joint agenda related to the transition to democracy, building a new social pact, the new Congress convening a constituent assembly and the drafting of a new constitution for the State of Oaxaca.
To achieve our aspirations of life, we must banish the current authoritarian regime and has a real change of government in Oaxaca and for this, all social actors, exercising our rights as citizens, must participate actively and decisively in the current political process election.

therefore call on:

FIRST: to make a huge event, inclusive and democratic, with the participation of the colonies, neighborhoods, communities, towns, municipalities, organizations, fronts and unions to create a great discussion in which deepen the fundamental issues relating to this forum transition to democracy, the call for a new social and new constituent congress and the development of a new constitution for Oaxaca. Above to give continuity to this process and others conducted in this context by the social movement in Oaxaca.

SECOND: That this event took place in the city of Oaxaca, by 20 June this year, during which we lay the groundwork for the new social contract that requires Oaxaca and dismantle the authoritarian schemes of the old PRI regime.

THIRD: The Democratic Teachers Oaxaca, that consistent with its social and democratic, participate jointly in this agenda and path we have begun to draw, and bring together the required change in Oaxaca.

FOURTH: To the people of Oaxaca, to unite all our forces and have an active, proactive and decisive in the ongoing political campaign to defeat at the polls, the PRI - Government as a step towards peace , democracy and justice in Oaxaca.

FREEDOM NOW!
to 12 prisoners in San Salvador Atenco

The ministers of the First Chamber of the Supreme Court:
Jose de Jesus Gudino Pelayo, Olga María del Carmen Sánchez Cordero de García Villegas, Juan N. Silva Meza, Arturo Zaldivar Lelo De Larrea, Jose Ramon Cossio Diaz.
A public opinion nationally and internationally. We

, we know the serious violations of human rights 3 and 4 May 2006 the Mexican State committed in San Salvador Atenco. Following these events 12 people still in prison. We are concerned that the process they followed was full of irregularities, was not respected the principle of presumption of innocence and the guarantees of due process and that the evidence on which his conviction was based was gathered illegally. We believe that these irregularities imply that they were entitled to a fair trial. It is a warning sign that the offense of "kidnapping" which we believe is unconstitutional, can be used to criminalize social demands and the system of law enforcement and justice administració n was used in a factious to become members of the Front offenders Peoples in Defense of Earth. We also know that there is legal precedent issued by an agency of the Federal Judicial Power, which held that the acts for which they were sentenced Ignacio del Valle, Felipe Álvarez and Héctor Galindo, do not constitute the crime of kidnapping; this background, even if normatively is not binding on the Ministers, we believe that for security and legal consistency as well as the implications of the case can not be ignored. Therefore, we call the First Chamber of the Supreme Court to free 12 prisoners of Atenco. IMPORTANT NOTE

Sore Throat Menstruation

Electoral Institute of Oaxaca, "referee sold? Litigation by affected application

Monday, May 31, 2010 23:10 Villaurrutia Homer

demonstrated that the opacity in the bidding process four vital programs to ensure transparent elections, and above all suspicion of fraud, State Electoral Institute (IEE) has been publicly challenged by the Coalition United for Peace and Progress " and by the national leaderships of the PAN and the PRD, to give clear accounts of all administrative and legal process that followed the General Executive Board, through the Procurement Committee, in order to consolidate contracts for just over 80 million for the development of material electoral printing ballots, electoral records and other documentation, general monitoring service to radio and television stations in Oaxaca

and operation of the Preliminary Electoral Results Program (PREP).
After denouncing the President of the IEE, José Luis Echeverría, as the instrument of the PRI and the state government to orchestrate a possible electoral fraud in Oaxaca Jesus Ortega, national leader of the PRD, and Cesar Nava, PAN's national president, stated that the Procurement Committee of the General Executive Board, chaired by its Director General, Othoniel Montor Melchor Pena, took powers because it did not correspond with On 10 February the General Council of the IEE only empowered the General Board to "establish" guidelines and procedures for carrying out the bidding for four programs. " Under no circumstances was authorized to receive proposals and issue rulings to sign contracts, said in a document, dated May 12, to which the headline: "Chronicle of announced an electoral fraud. "

companies which alluded to the PAN and the PRD are:
Verification and Monitoring, who was awarded a contract for 13 million 918 thousand pesos to take charge of monitoring the radio and television newscasts of the entity from the pre-campaign stage.
Proisi Group, SA de CV, Coahuila state, which was awarded a contract for 16 million 240 thousand pesos to implement the Preliminary Electoral Results Program (PREP) for the 4th of July.
Design, Rebuilding and Communication SA de CV, benefited from a contract in the amount of 39 million 810 thousand pesos for the preparation of all election material essentially screens and ballot boxes.
Litho Forms, SA de CV, whose legal representation signed contract to print the ballots and tally sheets for a total of 12 million 875 thousand pesos.
But the General Executive Board of the IEE not only violated an agreement by the General Council, but also informed the representatives of political parties accredited by the General Council on the background of the companies contracted, refusing also to provide the basis for the bidding process and to deliver copies of the contracts with each of the companies mentioned above.
The argument is obviously false: it is proprietary and confidential information, said the President, José Luis Echeverría. However, when I finally decided to report partial results of the tender had already delivered 50 percent down payment to the winning companies, a move that served to prevent the cast down the contracts, especially with the company Litho forms for printing of ballots and tally sheets. The report Othoniel

According to the report submitted by the Director General, Othoniel Pérez Montoro, at the special meeting of the General Council of the IEE meeting on 10 May, the Procurement Committee of the IEE conducted national competitive bidding the hiring of General Monitoring Service Radio and Television acquiring the rules of the call only two companies: Verification and Monitoring and BDTR.Net SA de CV
Without going into details in his report Montor Peña reports that on March the company only applied for Monitoring Verification and registration "contest", why, and then run out the stages of receiving technical and financial proposals, the Committee ruled in his favor, in the presence of the Comptroller, Juan Ruiz Aquino and counselor Ariel Orlando Morales.
The report fails to mention the background of the companies fined recently by the State Institute of Veracruz by inconsistencies in their work and for failure contract, and why, before the recording of a single company, there was not awarded the tender to convene a restricted invitation, as established state and federal regulations on the subject.
With respect to public tender for the procurement of electoral material, the Director General of the EIA reported that companies who bought the call guidelines were Dicaplast, Design, Rebuilding and Communication, Box Graf, Forms and Aprocel Fine. In total five companies also registered for the contest.
However, the report says, "in the analysis and verification of documentation and requirement, the only company that met all design requirements was requested, Reconstruction and Communication ", who eventually was awarded the contract.
Coincidence or cunning plan, but the fact is that three years ago in the electoral process of 2007 in the state of Tlaxcala, companies Dicaplast, Graf and Design Building, Reconstruction and Communication participated in the national public tender called by the electoral body of that entity. And at that time the contract was assigned to the company Dicaplast.
For the tender to operate the PREP, the Procurement Committee of the General Meeting of IEE you processed the purchase of the bases of the call and registration only Proisi Group Company. In this way the bid was a mere simulation to cover up what the facts are established in a direct award to a company that, among its negative background, is the fact that he dropped the PREP system in the 2007 election in the state of Veracruz.
For the acquisition of election material outlined in the Report of the Director General of the IEE, companies competed and Litho Forms Smart Forms, assigning the contract to the latter "who met all established requirements." Hide information
Adviser
President
All these alleged bid were observed between the months of February and the first half of April. And during that period only the representative of the Convergence Party, Victor Hugo Alejo Torres, emphasized to the President of the IEE, José Luis Echeverria for documentary information from the process without getting a positive response, behavior that led to resort to the State Electoral Tribunal and the Court the Judiciary of the Federation to try to achieve by this route.
However, his position was not supported either by Dagoberto Carreño, the PAN representative to the General Council of the IEE, and by Antonio Álvarez Martínez, representative of the PRD, both mentioned in the newspaper column Interdict News to respond to interests contrary to those of the opposition coalition and acting in complicity with Echeverría Morales.
However, since many of the irregularities detected with these four bids were discussed in the Daily News by the writer Isidoro Yescas, the subject began to gain ground in the same newspaper, fill the pages of other local and national newspapers, to become a matter of public interest.
The press revealed the opacity of the IEE

In an article entitled "IEE: simulation and opacity", published in two parts 4 and 5 May, IISUABJO investigator and former director of elections in Oaxaca State Electoral Institute, wrote:
"For services where you are putting not only the proper exercise of public resources allocated to the electoral body, but the ethical, moral and professionalism of the winners, and the credibility of the electoral body, it is imperative demand accountability right attached to each of the tenders.
"The initial resistance to report their own results and the partiality of information now pouring in the transparency of the IEE website at least it generates is suspected," she complained.
In response, on May 6 the President of the IEE bought the main headlines of all newspapers to clarify that local bids were "legal and transparent", as stated in the Director General.
was in this context that on 10 May, surprisingly, the Minister President José Luis Echeverría Morales convened a special session of the General Council of the IEE for Perez Othoniel Montor render a report on the bids, it was severely compromised by Representatives of the PAN and the PC.
At the same meeting, Echeverría Morales objected to the appearance of Internal Controller, Juan Ruiz Aquino, to explain how they are carried out each of the tenders and, likewise, refused to provide information on the homes of the winners. President Chief Denies
show
contract, however, a new session of the General Council of the IEE, on Sunday 16 May, the issue of tenders was again approached by the directors and representatives of political parties. After a prickly discussion, would take the agreement that the full Board would serve as the permanent committee "to monitor the bidding," and the activities of the four companies to whom the General Board had awarded contracts totaling 80 million pesos.
However, Echeverría Morales again refused to show and deliver copies of contracts signed between enterprises IEE Verification and Monitoring Lithoformas, Proisi and Design Group, Rebuilding and Communication. This practically nullified the integration of the standing committee, as the legal basis to follow up on each of the commitments signed by the said companies are or should be included in the contracts. Long list of

irregularities IEE
The scandal led to tenders and award of contracts by the General Executive Board of the IEE, was really just one more chapter in the long list of irregularities that had incurred the national election since the beginning of the process in November 2009.
At that time the first negative signal from the President Echeverría Morales was its resistance to standard and update the list of the names. Reluctant to do so since the initial project was to use the pattern of federal elections of 2009, the IEE eventually sign with the Federal Register of Electors a convention rather bounded in scope, after Echeverría Morales was terminated by the PRD representative Wilfredo Vasquez, Congressional seats in the local.
Later, in February 2010, the State Electoral Tribunal ordered to revoke the appointment of officers and directors of the 25 electoral districts According to the General Council of the IEE had taken December 26, 2009, without following the statutory procedure set out in the CIPPEO, which prompted the filing of an appeal before the TEE by Victor Alejo Torres, representative of the Convergence Party .
The General Council of the IEE complied with the resolution, but only to fill the forms and ratify the directors appointed in December and had already been agreed by Echeverria Morales with representatives of the PRI, PAN and PRD.
However, nothing could put more into question the impartiality and credibility of the electoral body that the decision taken by the General Council of the IEE to serve on district councils the polling stations with citizens and officials had already participated in local elections in 2007 and 2009 federal and, according to unofficial sources, most were already controlled by the PRI.
Judiciary of the Federation rules against IEE

The agreement, ratified by the State Electoral Tribunal would be reversed by the Court of the Judiciary of the Federation to consider that questioned the principle of certainty, that empowers CIPPEO electoral body to use a different mechanism to set the standard, ie the balloting, only in exceptional cases, which are not justified in this case. Under these conditions the
TPJF ordered the General Council of the IEE replace the procedure, all of which resulted in the balloting of citizens, to their training by the IEE and the integration, again, the polling stations, a task that many inconsistencies and difficulties staff continues to develop the electoral body.
In this way the referee of the contest is far from impartiality, professionalism and transparency, which demands a process of vital importance such as electing the governor, the state members of Congress and mayors.

Meanwhile, the president of the municipal committee of the PRD in Tehuantepec, José Manuel Jiménez Chiñas indicated that continue to support the social project of Yesenia Nolasco, "who is characterized by always working with people and near them" through the Juana Foundation. C. Romero.
